A Word from Management

We’re not big fans of legalese, but since we partner with several major wireless carriers to deliver our service, the lawyers require the following terms and conditions to be posted on the website.

Account Terms

canareze provides this web site, the device management website, remote monitoring devices, wireless monitoring, and notifications (“Service”) to you subject to these terms and conditions of use (these “Terms”). Please read these Terms carefully before using the Site. By accessing or using the Site or by merely browsing the Site you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, you may not use the Site.

canareze reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at http://www.canareze.com.

Violation of any of the terms below will result in the termination of your Account. You agree to use the Service at your own risk.

The services we provide are for your own use only. You may not resell, lease or provide them in any other way to anyone else.

Privacy Policy

Please refer to the canareze privacy policy, available at http://www.canareze.com/privacy. By using the Site you agree to our use, collection, and disclosure of personally identifiable information in accordance with the Privacy Policy.

Payments, Refunds, Taxes, and Upgrading/Downgrading

A valid credit card is required for paying accounts. The Service is billed in advance on a monthly basis and is non-refundable after your first month of service. There will be no refunds or credits for partial months of service, or upgrade/downgrade refunds. No exceptions will be made. For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged the new rate on your next billing cycle. Downgrading your Service may cause the loss of Content, features, or capacity of your Account. canareze does not accept any liability for such loss.

All hardware purchases can be returned within 30 days of purchase for a full refund minus shipping and handling. If you selected free shipping and handling at the time of purchase you will be refunded your purchase price minus the shipping and handling fees used to deliver your order.

Fees and any other charges for the use of the Site are described on the Site. They may change from time to time. If we change them, we will give you at least 30 days’ notice. If they do change, your continued use of the Site after the change indicates your agreement with the new fees and charges after the effective date of the change. Any change to fees and other charges will not be applicable to the billing period in which the change occurs.

You are responsible for all taxes applicable to the fees in any applicable jurisdiction.

Providing a Secure & Reliable Service

Canareze takes reliability and security seriously. We put a great deal of effort into ensuring that the Service operates all the time, and that it is a secure environment for your data. We use what we believe to be “best-of-class” hosting services and security technologies and services.

However, no system is perfectly secure or reliable, the internet is an inherently insecure medium, and the reliability of hosting services, internet intermediaries, cellular network operators, your internet service provider, and other service providers cannot be 100% assured. When you use canareze, you accept these risks, and the responsibility for choosing to use a technology that does not provide perfect security or reliability.

You hereby acknowledge that quality and availability of the canareze Services may be affected by factors outside canareze control, such as (but not limited to) physical obstructions, atmospheric conditions and other causes of radio interference and by faults in other telecommunication networks to which the Network is connected. In connection with any such adverse effect on the quality and availability of the canareze Service canareze shall incur no liability to you whatsoever. Notwithstanding such effects to the canareze Services during your term of use, you shall remain liable for the payment of the Monthly Service Charge. You acknowledge that Service may be temporarily refused, interrupted, curtailed or limited because of atmospheric, terrain, other natural or artificial conditions and may be temporarily interrupted or curtailed due to usage concentrations, modifications, upgrades, relocation and repairs of transmission Facilities. You agree that the underlying wireless service carrier shall not be responsible for such interruptions of Service or the inability to use the Service outside the United States. You understand that the underlying wireless service carrier cannot guarantee the security of wireless transmissions and will not be liable for any lack of security relating to the use of the Service.

Cancellation & Termination

You and canareze may terminate these Terms and your use of the Service at any time. You are solely responsible for properly canceling your account. You can cancel your account at any time by clicking on the My Account link in the navigation bar at the top of the screen. The My Account screen provides a simple no questions asked cancellation link and is instantaneous.  You may also call us or email support to cancel your account. However, if you call or email us, your account is not considered cancelled until confirmed by canareze (for instance, leaving a voicemail after hours will not instantly cancel your account). All of your Content will be immediately deleted from the Service upon cancellation. This information cannot be recovered once your account is cancelled.

If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again. canareze, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other canareze service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. canareze reserves the right to refuse service to anyone for any reason at any time.

Ownership, Copyright, and Trademarks

canareze claims no intellectual property rights over the material you provide to or generate with the Service. Your profile and content remain yours. However, by setting your devices to be shared publicly, you agree to allow others to view and share your Content. We also need the right to use your Content to the extent necessary to operate the Service now and in the future.
Therefore, by posting or distributing Content to or through the Service, you (a) grant canareze and its affiliates and subsidiaries a non-exclusive, royalty-free, transferable right to use, display, perform, reproduce, distribute, publish, modify, adapt, translate, and create derivative works from such Content on the Services, in the manner in and for the purposes for which the Service from time to time uses such Content; (b) represent and warrant that (i) you own and control all of the rights to the Content that you post or otherwise distribute, or you otherwise have the lawful right to post and distribute that Content, to or through the Service; and (ii) the use and posting or other transmission of such Content does not violate these Terms and will not violate any rights of or cause injury to any person or entity.

Use of the Service

You must be 13 years or older to use the Service. Accounts registered automated methods are not permitted. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process. You are responsible for maintaining the security of your account and password. canareze cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. One person or legal entity may not maintain more than one free account. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not directly or indirectly: reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, object code or underlying structure, ideas, algorithms of the Service and related hardware. If your usage of the Service significantly exceeds the average usage (as determined solely by canareze) of other canareze customers, we reserve the right to immediately disable your account or reduce your service level until you can reduce your usage of the Service. Examples of exceeding average usage include excessive telephone or SMS/Text message alerts, excessive data transfer to/from the device management website, and initiating a monitoring interval frequency that is not available with your current level of service.

Your Service operates on the mobile phone network and as such requires a SIM card for use. Each canareze wireless monitor includes a SIM card. The SIM card remains the property of the wireless carrier. Your canareze service and SIM card are authorized only for use in the United States. Any use of the SIM card outside of the United States will be billed through to your account at international roaming rates and your account will be terminated.

If a SIM Card is lost, stolen or damaged you must notify canareze of the same in writing as soon as reasonably possible. You will remain liable for all charges incurred by the use of the SIM Card until you have notified canareze as aforesaid. On notification of a lost, stolen or damaged SIM Card canareze, at your request shall provide a replacement. canareze reserves the right to make a charge for issuing a replacement SIM Card.

Warranty Disclaimer

The Service is provided to you on an “as is” basis without warranties from canareze of any kind, either express or implied. canareze expressly disclaims all other warranties, express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. canareze does not represent or warrant that Content is accurate, complete, reliable, current or error-free, and expressly disclaims any warranty or representation as to the accuracy or proprietary character of the Service, the Content or any portion thereof.

While canareze attempts to make your access to and use of the Service safe, canareze does not represent or warrant that the Site or any Content are free of viruses or other harmful components.

Limitation of Liability; Indemnity

You waive and shall not assert any claims or allegations of any nature whatsoever against canareze, its affiliates or subsidiaries, their sponsors, contractors, advertisers, vendors or other partners, any of their successors or assigns, or any of their respective officers, directors, agents or employees (collectively, the “Released Parties”) arising out of or in any way relating to your use of the Service or the Content, including, without limitation, any claims or allegations relating to the alleged infringement of proprietary rights, alleged inaccuracy of Content, or allegations that any Released Party has or should indemnify, defend or hold harmless you or any third party from any claim or allegation arising from your use or other exploitation of the Service. You use the Service at your own risk.

Without limitation of the foregoing, neither canareze nor any other Released Party shall be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the Site or the Content, including without limitation any damages caused by or resulting from your reliance on the Service or other information obtained from canareze or any other Released Party or accessible via the Service, or that result from mistakes, errors, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorized access to canareze or any other Released Party’s records, programs or Services.

In no event shall the aggregate liability of canareze, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the Service exceed any compensation paid by you for access to or use of the Service during the three months prior to the date of any claim.

You shall defend, indemnify and hold harmless canareze and the other Released Parties from any loss, damages, liabilities, costs, expenses, claims and proceedings arising out of your use of the Service.

The Service is not designed, intended, or authorized for use, intended for, or in relation to the operation of, weapons, weapons systems, nuclear installations, means of mass transportation, aviation, life-support computers or equipment (including resuscitation equipment and surgical implants), pollution control, hazardous substances management, or for any other application in which the failure of the Goods or canareze Services could create a situation where personal injury or death may occur. Should you use Service for any such unintended or unauthorized application, you shall indemnify and hold canareze and its officers, employees and affiliates harmless against all claims, costs, damages, expenses, and reasonable attorney fees arising out of, directly or indirectly, any claim of personal injury, death, or other damages associated with such unintended or unauthorized use, even if such claim alleges that canareze was negligent regarding the design of the Goods or Services.

Communications

canareze reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the canareze Site (http://www.canareze.com) or the Service itself. canareze shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
